Returns and exchanges of goods of improper quality that were bought remotely or in stores
If the buyer discovers any defects in the goods and demands a replacement, the seller replaces the goods within seven days from the time the buyer demands a replacement, and if additional quality control of such goods is required, within twenty days from the time the demand is made. If at the moment of demand there are no goods required for replacement, the goods must be replaced within one month from the date of such demand. The buyer’s claims for a proportional reduction of the purchase price of the goods, reimbursement of the costs of repairing defects in the goods by the buyer or a third party, return of the money paid for the goods, as well as the claim for compensation for losses incurred by the buyer due to selling goods of improper quality, or providing inadequate information about the goods. Subject to satisfaction by the seller within ten days from the date of the claim.
Claims for return of goods of inadequate quality can be made within the following terms:
- if the goods have a warranty period. during the warranty period;
- If the goods have no warranty period. within a reasonable period, but no more than 2 years.
In the case of dispute on the causes of defects, an examination is appointed, which is held within 20 days. For the return and exchange of goods of improper quality the buyer:
- sends the seller a written application for the return (exchange) of the goods, indicating the reason for the return (exchange);
- provides documents confirming the fact and conditions of the purchase of goods;
- provides the defective product in its entirety.
If the goods of inadequate quality purchased remotely, the buyer sends to the seller at his own expense. The seller receives the returned goods. If the claim for return is recognized as valid, the cost of delivery of the goods is reimbursed to the buyer. If a defect is detected in a product you have purchased, you are entitled to file one of the claims listed in Art. 18 of the Law of 07.02.The seller has the right to file a claim within 15 calendar days from the date of purchase.
Nevertheless, if the product in question is classified as a technically complex item, as defined in Art. by the Government Decree of November 10, 2011. N 924, then the specified in Art. 18 claims can be asserted only within 15 calendar days from the date of purchase. After 15 days, it is possible to make these claims in cases where:
- a significant defect has been detected;
- The terms for elimination of the defects have been violated;
- The product cannot be used for more than thirty days in the aggregate during each year of the warranty period in connection with the need to eliminate manufacturing defects.
At submission of the claim by the buyer, the seller has the right to carry out quality check of the goods. In this connection, the buyer gives the seller the purchased goods along with the claim.

If the buyer does not agree with the results of the quality inspection, he/she has the right to make a written request for an examination of the goods. The expertise is conducted at the seller’s expense.
If the expertise establishes the presence of defects that are not the fault of the seller (manufacturer), the buyer must reimburse the seller the costs of the examination.
The terms of the examination in accordance with the law Refund of funds:
- If the goods were paid for by a bank card. the refund is only made to the card of the buyer who paid for the goods;
- If the goods were paid in cash. the money is paid from the company’s cash register.

Return of the goods is possible only if the buyer meets the following conditions:
- the buyer sends the seller a written application for the return of the goods, indicating the reason for return;
- provides documents confirming the fact and conditions of the purchase of goods;
- The appearance and consumer properties of the goods must be preserved.
Money refund is to be made within 10 days after receipt of the relevant claim by the seller. The sum paid by the buyer for the goods, except for the expenses of returning the goods, is subject to refund.
In addition to the right to exchange the goods of proper quality under the Act of 07/08/2006 on the sale of non-conforming merchandise, the seller is entitled to reimbursement.02.According to the Law of Ukraine N 2300-1 “On Protection of Consumer Rights”, you can reject the goods purchased remotely at any time prior to its delivery, as well as within seven days after delivery of goods.
The buyer may exchange the goods of proper quality for similar goods, if the goods are not suitable in shape, dimensions, colors, size or completeness within fourteen days. Exchange of goods of appropriate quality is carried out, if the goods were not used, preserved its trade dress, consumer properties, seals, labels, and also have a cash or cash voucher or other document confirming the payment for this product. Absence of a receipt or other document confirming payment for goods does not deprive the buyer of the right to refer to testimony. The list of goods that cannot be exchanged or returned on the above grounds is determined according to the procedure established by law or other legal acts (Government Resolution of the 19.01.1998 5).
The buyer may, within fourteen days from the date of delivery of the goods, exchange the purchased goods, intended for personal, family, household or other use, not connected with business activities, for a similar product of different size, shape, dimension, color or completeness (Art. 492 CIVIL CODE ).
If the seller does not have the necessary goods for exchange, the buyer can return the purchased goods to the seller and receive the money paid for them.
The buyer’s claim for an exchange or return of goods is subject to satisfaction, if the goods have not been used, preserved its consumer properties and there is evidence of its purchase from the seller.
When returning/exchanging goods of proper quality, you must keep the trade dress, package integrity and completeness. Presence of exploitation traces may be the basis for rejection of buyer’s claims.
(Art. 506 of the Civil Code), the Supplier, engaged in entrepreneurial activities, undertakes to transfer the goods to the buyer within the specified period for their use in business activities or for other purposes not related to personal, family, household and other similar uses:
- If any manufacturing defects of the goods are detected during installation, adjustment and operation during the warranty period, the Purchaser shall have the right to draw up an act of detected defects (incompleteness) of goods in the presence of the commission with the Supplier and/or representatives of the Chamber of Commerce and Industry or other expert organization. Calling the Supplier’s representative is obligatory. Supplier must arrive within ten (10) calendar days of receipt of Buyer’s notice to participate in the commission. If the Supplier fails to appear, the Buyer shall draw up an act with the participation of representatives of the Chamber of Commerce or other expert organization. If it is established that the goods do not meet the quality (completeness) requirements of this Agreement the Supplier shall within 14 (fourteen) calendar days from the date of receipt of the Buyer’s claim to replace the said goods with goods of proper quality (complete) or refund the Buyer’s price, reimburse the losses incurred by the Supplier (except for lost profits), pay the costs of the expertise by the Buyer;
- Return and exchange of quality goods is possible by agreement of the parties, in cases stipulated by the legislation or by legally effective court decision.

- cable products (wires, cords, cables);
- construction and finishing materials (film) and other goods sold by the metre;
- household goods;
- technically complex household goods, for which a warranty period (electrical household machines and appliances);
- Non-recurrent goods (brochures);
- the full list is defined in the Government Decree of 19.01.1998г. 5.
If similar goods are not on sale on the day the buyer appeals to the seller
The buyer has the right to refuse to fulfill the purchase and sale contract and to demand a refund of money paid for the specified goods. The buyer’s claim for a refund of the sum of money paid for the goods in question is subject to satisfaction within three days from the day of returning the goods in question. By agreement between the buyer and the seller, an exchange of goods may be provided when similar goods are on sale. The seller is obliged to inform the buyer immediately about the availability of similar goods for sale.
Defective goods under warranty
If defects are detected in the purchased goods during the established warranty period, the buyer has the right at his option:
- To demand replacement of the goods with the goods of the same brand (the same model and (or) article number😉
- To demand replacement with the same product of another brand (model, article) with a corresponding recalculation of the purchase price;
- to demand a proportional reduction in the purchase price;
- demand immediate removal of the defects of the goods without compensation or reimbursement of the expenses for their correction by the consumer or a third party;
- Refuse to fulfill the contract of sale and demand a refund of money paid for the goods. In this case you are obliged to return the goods with defects to the seller at his expense.
With regard to technically complex goods, if defects are found in it, you have the right to choose:
- To refuse to fulfill the contract of sale and to demand a refund of the amount paid for such goods;
- to make a claim for its replacement with the goods of the same brand (model, article) or with the same goods of another brand (model, article) with a corresponding recalculation of the purchase price.
The deadline for filing the above claims is 15 days from the date of delivery of such goods to you. After the expiration of the specified 15-day period, these claims are subject to one of the following cases:
- discovery of material defects of the goods (material defects of the goods: an irremovable defect or a defect that can not be eliminated without disproportionate costs or time, or revealed repeatedly, or appears again after its elimination)
- Violation of the deadlines for eliminating defects in the goods as established by the Law “On Protection of Consumer Rights”;
- the inability to use the goods during each year of the warranty period in the aggregate more than thirty days due to the repeated elimination of various deficiencies.
If you bought a discounted or defective product and were warned in advance in writing about the defects that caused the markdown, claims regarding these defects are not accepted.
